Shoshana E. Bannett joined Bird Marella in 2015. She has a broad range of litigation and trial experience, having represented clients in contract, legal malpractice, white collar criminal defense, securities, False Claims Act, employment, internal investigations, immigration, and other matters in state and federal court, as well as arbitration proceedings before AAA and JAMS.

In her recent success, she obtained a complete dismissal of an employment complaint on statute of limitations grounds for a leading provider of tax credits consulting services.

Prior to Bird Marella, Ms. Bannett practiced at Munger, Tolles & Olson LLP.  She served as a law clerk to the Honorable Emilio M. Garza of the United States Court of Appeals for the Fifth Circuit as well as the Supreme Court of the Republic of Palau.

Representative Cases

  • Prevailed in highly-publicized trial against real estate developer Mohamed Hadid regarding the hillside mansion in Bel Air he illegally constructed. Obtained orders to fully demolish the home (after first securing partial demolition), won a multimillion-dollar award in damages at trial, and defeated Hadid’s specious counterclaim.

  • Obtained preliminary injunction in a pro bono class action lawsuit against federal prison over the inefficient measures taken by prison officials to prevent the spread of COVID-19, in violation of the Eighth Amendment prohibition against cruel and unusual punishment. Successfully convinced the court to require prison officials to consider all medically vulnerable, non-violent prisoners and those over the age of 50 for home confinement.

  • Achieved complete defense decision on behalf of the world’s largest plastic pipe manufacturer in a long-running, high-profile qui tam trial involving nine-figure damages relating to non-compliant PVC pipe. Successfully convinced the court to reduce claimed damages from $58 million to $2 million before the jury was ultimately unable to agree that any damages were owed, leading to a mistrial.

  • Trial counsel for Cyntron Payroll Solutions, a leading provider of payroll software solutions, in a two-week jury trial involving eight-figure damages claims for breach of fiduciary duty, defamation, and intentional infliction of emotional distress brought by the company’s former president. Obtained a complete defense verdict.
